The team of BTLX recommends you to read the following User Agreement (otherwise referred to as simply and unequivocally as “Agreement” or, alternatively, "Document"). Read it attentively before you enable, activate, and start using the ByteLixir application, which is made available by BTLX and our team (this software is called both “ByteLixir application" or “ByteLixir app" in this Document). By taking this step, you automatically fully consent to abide by and observe the Terms and Conditions put forward by this Agreement, in their entirety. In the event you reject all the stipulations put forward by this Document, or just a single one of them, you have no right to try the ByteLixir application in action. That is, do not attempt to enable, activate, and begin using the ByteLixir application in this case. Instead, simply leave this page.

YOU ARE EXPLICITLY AND UNEQUIVOCALLY PROHIBITED FROM MAKING USE OF THE BYTELIXIR APPLICATION IN THE FOLLOWING SITUATIONS AND SCENARIOS:

• YOU, AS A USER, HAVE NOT YET REACHED THE LEGAL AGE IN YOUR APPLICABLE CURRENT JURISDICTION. THE SAME HOLDS TRUE IF YOU, IN ANY OTHER FASHION, ARE LEGALLY INCOMPETENT TO ENTER INTO A LEGALLY BINDING AGREEMENT AS A FULL-FLEDGED PARTY;
• YOU HAVE NO RIGHT TO MAKE USE OF THE BYTELIXIR APP OR DIGITAL PRODUCTS OF A SIMILAR CLASS UNDER ANY OF PERTINENT LAWS. THE LATTER TERM INCLUDES THE LAWS OF YOUR CURRENT JURISDICTION OR THE JURISDICTION WHERE YOU ACTUALLY ARE USING THE BYTELIXIR APP;
• YOU ARE NOT ALLOWED TO ENTER INTO ANY AGREEMENTS RESEMBLING THIS VERY DOCUMENT BY LEGAL AGREEMENTS CONCLUDED WITH YOUR INTERNET SERVICE PROVIDERS, MOBILE SERVICE PROVIDERS, AND ALIKE., THAT, ALONG WITH OTHER THINGS, FRAME HOW YOU CAN SHARE YOUR INTERNET TRAFFIC, IPS, AND DEVICES' RESOURCES;
• YOU ARE CURRENTLY ENGINEERING OR HAVE ENGINEERED A RIVALING DIGITAL PRODUCT AND INTEND TO GET ACCESS THE BYTELIXIR APPLICATION FOR THE PURPOSES OF MARKET COMPETITION (INCLUDING, BUT IN NO WAY LIMITED TO, EXPLORING ITS AVAILABILITY, ACCESSIBILITY, PERFORMANCE, POTENTIAL, USER TERMS AND CONDITIONS, FEATURES, FUNCTIONALITIES, PROMOTIONS, AFFILIATE SCHEMES, STAFF, ETC.).

Profile of the ByteLixir App

The ByteLixir application works as software engineered to make use of your IP and free available resources of your devices for the purpose of downloading various web pages in the background. Referral Program

On top of that, the ByteLixir application also makes users eligible to participate in our referral program. 6. Deliberately or inadvertently breach any applicable local, state-level, national-level or international law. The same applies to various existing rules associated with any securities’ exchange.

You admit that BTLX may or may not pre-screen content. This fact means the BTLX team and its assignees do have the right (yet, not the obligation), at their sole and exclusive discretion, to pre-screen, reject, or delete any content available via the ByteLixir application. Without limiting the aforementioned provision, BTLX, together with our assignees, does have the full right to delete any content that violates or otherwise neglects applicable laws and regulations or the stipulations of this Document. The latter also applies to situations when such content is viewed objectionable, for any possible reason.

You admit, realize, and agree that BTLX may exercise access to, preserve and reveal your account info if it is mandated by applicable laws or in a good faith belief that such access, preservation, or disclosure is reasonably needed to: (i) abide by legal processes of any sort; (ii) enforce this very Document; (iii) respond to any claims that any content breaches the rights of external third parties; (iv) respond to your requests when customer support and services are needed; or (v) protect the rights, property, or personal security of BTLX, our team and users, and the general public.

Modifications

BTLX reserves the full right to alter, suspend or discontinue, temporarily or permanently, the ByteLixir application or any service to which the latter might be linked to, with or without notice and without liability to you or any other users or parties.

Disclaimer of Warranties

BTLX IS PROVIDING THE BYTELIXIR APP ON AN “AS IS” BASIS. WE EXPRESSLY AND TOTALLY DISCLAIM ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPLICIT OR IMPLIED TO THE CONDITION, VALUE, AND QUALITY OF THE BYTELIXIR APP, COVERING, WITHOUT ANY LIMITATION, ANY WARRANTIES OF MERCHANTABILITY, SUITABILITY, OR SUITABILITY FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY, ACCURACY, ABSENCE OF VIRUSES, MALWARE, OR ANY DEFECT, WARRANTIES STEMMING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. BTLX FURTHER EXPLICITLY DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES THAT THE USE AND FUNCTIONING OF THE BYTELIXIR APP BE CONTINUOUS, UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DATA AND INFORMATION CONTAINED THEREIN WILL BE ACCURATE OR COMPLETE.

Limitation of Liability

In no event and in no case or scenario can BTLX be held liable, under this Document, for any consequential, special, indirect, incidental, or punitive damages or for any possible loss, profits or revenue (whether in contract, tort, negligence, or any other legal framework) in any fashion relating to this Document (“Event”), even if BTLX had been informed in advance of the possibility or likeliness of such damages. BTLX’s aggregated liability under this Document for any possible claim or damage or series of them is limited to the amount that cannot exceed US$50.

Termination-related Issues

This Agreement shall remain in effect and force until terminated by you or BTLX. BTLX might, at its sole and exclusive discretion, at any moment and for any or no purpose, suspend or terminate this Agreement, both with or without prior notice. This Document will get terminated straight away, without prior notice from BTLX if you fail to abide by with any stipulation and point of this Document. You can terminate this Agreement by opting out of our network via the ByteLixir application settings. You can also terminate this Agreement by deleting the ByteLixir application and all of its copies from your device(s).

Final Stipulations

This Document explicitly means the end-to-end mutual comprehension between the parties involved, concerning all the matters and issues covered and described by this Document.

All notices or other communications stemming from this Agreement are to be sent by e-mail to the e-mail address provided by the parties as part of the registration to the ByteLixir application.

This Agreement is to be governed by the laws and regulations of Singapore, excluding possible conflicts of law rules, and the courts of Singapore are to have exclusive jurisdiction over the parties involved.

In case any provision, stipulation, or point of this Agreement is held by a court of applicable jurisdiction as contrary to any law or regulations, all remaining provisions, stipulations, and points stay in full force and effect as if such problematic provision never existed.

No failure or delay on the part of any party hereto in exercising any right, power or remedy hereunder shall act as a waiver thereof.

BTLX may, at any moment, and at its sole and exclusive discretion, alter this Agreement, with or without notice to the client. Any such alteration will be effective straight away after public posting. If the client keeps on using the BTLX systems, solutions, and services, after any such alteration, this fact amounts to approval of the altered Agreement.
